Terms of Service

Welcome to CANI. CANI is a digital community matching platform for diaspora members residing in Canada. It allows posting currency exchange listings and participating in community tontines among consenting members. Fundamental principle: CANI is exclusively a digital bulletin board. The platform does not receive, hold, transfer, or guarantee any funds. It does not set any exchange rate and does not intervene at any stage of transactions between members.

1.2 — Acceptance of terms

Access to and use of the CANI platform implies full acceptance of these Terms of Service. By creating an account or posting a listing, the member acknowledges having read, understood, and accepted these terms.

  • ·Acceptance is materialized by a mandatory checkbox at sign-up.
  • ·Any use of the platform after modification of these Terms constitutes acceptance of the new terms.
  • ·Minors under 18 are not authorized to use the platform.

1.3 — Sign-up and members

Access is reserved for registered members. Sign-up requires accurate, complete, and up-to-date information. CANI reserves the right to verify members' identity and refuse or suspend any account whose information appears inaccurate or fraudulent.

  • ·Each member may only hold one active account.
  • ·The member is responsible for the confidentiality of their login credentials.
  • ·Any activity from an account is presumed to be made by the account holder.

1.4 — Listings (Currency exchange)

The currency exchange feature allows members to post listings indicating their wish to exchange one currency for another. These listings are purely indicative and do not constitute any firm offer or contractual commitment by CANI. CANI does not handle any funds. Rates shown are provided as indication only by third-party sources (exchangerate.host). CANI is not responsible for their accuracy or updating.

  • ·Transactions occur exclusively between members, outside the platform.
  • ·CANI is not a party to transactions and does not guarantee their execution.
  • ·Members assume full responsibility for the exchanges they conclude.
  • ·Any fraudulent or illicit listing is strictly prohibited.

1.5 — Community tontines

The Tontines feature allows members to organize collectively within a rotating community savings system. This arrangement operates exclusively among consenting members and does not involve any financial intermediation by CANI.

  • ·CANI is not the custodian of tontine funds.
  • ·Members organize and manage their tontines autonomously.
  • ·CANI only provides coordination and communication tools.
  • ·Any dispute between tontine members is settled directly among the concerned members.

1.6 — Liabilities and limitations

Within the limits permitted by applicable law, CANI cannot be held liable for financial losses, direct or indirect damages, harm of any kind resulting from exchanges between members, non-execution of a transaction, inaccuracy of information posted by members, or any service interruption.

1.7 — Prohibited behaviors

It is strictly forbidden to use the platform to:

  • ·Post false, misleading, or fraudulent information.
  • ·Facilitate money laundering or illicit financing activities.
  • ·Circumvent regulation applicable to money services.
  • ·Harass, threaten, or intimidate other members.
  • ·Collect personal data of other members without consent.

1.8 — Suspension and termination

CANI reserves the right to suspend or terminate a member's access without notice in case of violation of these terms, proven fraudulent behavior, or upon request from competent authorities.

3 — Legal disclaimers (FINTRAC & AMF)

CANI is a technological community matching platform. It is not a financial institution, deposit-taking institution, savings and credit cooperative, or money services business within the meaning of Canadian legislation. CANI is not registered with the Financial Transactions and Reports Analysis Centre of Canada (FINTRAC) as a money services business (MSB), because it does not receive, process, convert, or transfer any funds on behalf of its members. Members using the currency exchange feature deal directly with each other. CANI is limited to providing a listing display space, without any intervention in the execution of exchanges.

  • ·Always perform your own verifications before concluding an exchange.
  • ·Favor members with a verified profile and positive history.
  • ·Never transfer funds before receiving confirmation from the counterparty.
  • ·Keep records of all your communications and transactions.
  • ·In case of suspected fraud, report it to the police and to CANI immediately.

4 — Legal framework for community tontines

Tontines organized via CANI are informal mutual financial aid arrangements between consenting members, inspired by traditional community practices (ROSCA — Rotating Savings and Credit Associations). They do not constitute regulated financial products. CANI only provides coordination tools (round management, reminders, communication). The platform is not the custodian of funds, does not guarantee payments between members, and is not a savings cooperative within the meaning of the law.

  • ·Participation in a tontine is voluntary and based on the informed consent of each member.
  • ·Contribution amounts, frequency, and order of receipt are defined by the group members.
  • ·Fund transfers occur directly between members, without transiting through CANI.
  • ·Each tontine group must designate a responsible administrator among its members.
  • ·A written agreement between members is strongly recommended before starting.
  • ·If the volume or frequency of tontines reaches a systematic level resembling deposit-taking or lending activity, the AMF of Quebec could classify these activities as regulated financial services. Organizing members assume full legal responsibility for their groups.

5.1 — Applicable law and jurisdiction

These terms are governed by the laws of the province of Quebec and applicable federal laws of Canada. Any dispute regarding the use of the platform shall be submitted to the exclusive jurisdiction of the courts of Quebec.

5.2 — Modification of terms

CANI reserves the right to modify these terms at any time. Members will be informed of any material modification by in-app notification at least 30 days before the changes take effect.
